Terms of Use

1. Acceptance of Terms

By downloading, installing or using SOPmate ("the App"), you agree to these Terms of Use. If you don't agree, please don't use the App.

2. Description of Service

SOPmate is a mobile app that helps businesses and individuals draft, review, save, share and export job safety analyses (JSAs), job hazard analyses (JHAs), Safe Work Method Statements (SWMS) and Standard Operating Procedures (SOPs) using AI tools. Features include voice-to-document conversion, process maps, a document library, checklist tools, export options, team collaboration, crew briefings and sign-offs.

AI features only run after you agree to them. You can use the App with AI off, with reduced features.

3. Free Allowance and Business Plans

The free plan includes 3 AI documents and 1 PDF export per month, including SWMS and JSAs. PDFs exported on the free plan include a SOPmate footer. Monthly allowances reset at the start of each calendar month (UTC). Without an account, you can create 1 document as a guest. Business plans are available on the following terms:

Prices may differ outside Australia and are shown in the App Store before you buy.

4. Billing and Cancellation

Payment is charged to your Apple ID account when you confirm the purchase. Monthly and annual subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

You can manage and cancel subscriptions in your App Store account settings. Deleting your SOPmate account doesn't cancel your subscription. The free monthly allowance is not a subscription trial. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Refund requests are subject to applicable law and App Store policies.

5. AI-Generated Content

SOPmate uses AI to generate SOPs, JSA/JHA drafts, SWMS and related workplace documents from your input. AI-generated content is a starting point and must be reviewed by a competent person before it is used in a workplace.

Documents generated by the App are not a substitute for professional work health and safety advice. You're responsible for making sure any document you use in your workplace meets the work health and safety laws, regulations and standards that apply where you work (in Australia, for example, the Work Health and Safety Act 2011 and relevant Australian Standards).

6. Team Features, Crew Briefings and Sign-offs

You're responsible for who you invite to your team and who you send crew briefings to. Anyone with a briefing link can view that briefing.

The App records sign-offs with the signer's name, the account that signed and the time. You're responsible for confirming that any document, signature or record you use meets your regulatory or contractual obligations.

7. User Responsibilities

You're responsible for keeping your account credentials confidential and for all activity under your account. You agree to:

• Use the App only for lawful purposes
• Not upload content you don't have the right to use
• Review all AI-generated documents before using them in a workplace
• Make sure your use complies with the work health and safety laws that apply to you
• Not attempt to reverse-engineer or misuse the App or its APIs

8. Intellectual Property

The App, its interface, features and underlying technology are owned by SOPmate and protected by copyright, trademark and other intellectual property laws. Content you create using the App, including your SOPs, SWMS documents and process maps, remains yours.

By using the App, you give SOPmate a limited licence to process your content solely to provide the service to you.

9. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.

Subject to that, and to the maximum extent permitted by law:

• SOPmate isn't liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the App, including workplace incidents, regulatory penalties or loss of data.
• SOPmate makes no warranty that AI-generated content is accurate, complete or fit for a particular purpose.
• Our total liability to you for any claim arising out of these Terms is limited to the amount you paid us in the 12 months before the claim.

10. Termination

We may suspend or terminate your account if you breach these Terms or if the law requires it. When your account ends, your right to use the App ends and we'll handle your data as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes are subject to the jurisdiction of the courts of Western Australia.

12. Changes to Terms

We may change these Terms from time to time. We'll tell you about material changes by updating the Last Updated date and, where appropriate, through the App. If you keep using the App after a change, you accept the updated Terms.
